1. Acceptance of Terms

By downloading, installing, or using the SpeakVerse mobile application ("App") or any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. Your continued use constitutes acceptance of these Terms and any updates.

2. Description of Service

SpeakVerse is a language practice platform that allows users to:

  • Create an account and maintain a profile (name, profile picture, bio, language preferences, and similar information).
  • Practice speaking with other users via voice calls (audio-only) and text chat.
  • Use AI-powered practice (e.g. RAHA AI) for conversation and language support within the App.
  • Improve vocabulary and grammar through interactive exercises such as vocabulary flashcards, quizzes, and sentence-building activities.
  • View leaderboards and rankings that display user progress and practice activity.
  • Save favorite practice partners and manage contacts within the App.
  • Receive push notifications for calls, messages, and other service-related alerts.
  • Use optional features such as translation (when enabled) and in-app feedback.

The App requires microphone access for voice calls and AI voice features, notifications for alerts, and may use Bluetooth for audio routing. Use of the App is subject to your device permissions and these Terms.

3. Eligibility and Account

  • You must be at least 13 years of age (or the minimum age in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement.
  • You are responsible for: (a) the accuracy of information you provide, (b) keeping your account credentials secure, and (c) all activity under your account. You must notify us promptly of any unauthorized use.

4. Acceptable Use and Conduct

You agree not to use the App to:

  • Harass, abuse, bully, threaten, or harm any other user.
  • Share content that is illegal, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your identity or affiliation.
  • Use the service for commercial solicitation, spam, or unsolicited advertising.
  • Attempt to gain unauthorized access to the App, other accounts, or our or any third party's systems or data.
  • Reverse engineer, decompile, or disassemble the App (except as permitted by applicable law).
  • Use automated means (bots, scrapers, etc.) to access or use the App without our written permission.
  • Violate any applicable law, regulation, or third-party rights.

We may suspend or terminate your account and access to the App if we reasonably believe you have violated these Terms or applicable law.

5. Voice Calls and Real-Time Communication

  • Voice calls are provided over the internet using real-time communication technologies. Quality and availability depend on your device, network, and third-party infrastructure.
  • You must not use the App for emergency communications. The App is not a replacement for traditional voice or emergency services.
  • You are responsible for your conduct and the content of your communications during calls and in chat. We may use reports, usage data, and other information to enforce these Terms and protect users.

6. Intellectual Property

The App (including its name "SpeakVerse", logo, design, and software) and all content we provide are owned by SpeakVerse or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the App or our content without our prior written consent.

7. Privacy and Data

Your use of the App is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights. By using the App, you consent to the collection and use of information as described in the Privacy Policy. Please read it carefully.

8. Third-Party Services

The App uses third-party services (e.g. authentication, push notifications, hosting, and communication infrastructure). Your use of those services may be subject to their respective terms and policies. We are not responsible for the availability, performance, or policies of third-party services.

9. Disclaimers

  • The App and all content and features are provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We are not responsible for the conduct of users or the content of their communications.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • SpeakVerse and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill, or other intangible losses) arising from or related to your use or inability to use the App.
  • Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred US dollars (USD 100), whichever is greater.
  • Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless SpeakVerse and its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the App, (b) your violation of these Terms or any law, or (c) your violation of any third-party rights.

12. Termination

  • We may suspend or terminate your account and access to the App at any time, with or without notice, for any reason, including breach of these Terms.
  • You may stop using the App at any time. Account deletion may be requested through the App or by contacting us; our Privacy Policy explains how we handle your data after deletion.
  • Provisions that by their nature should survive (including Sections 6–11 and this sentence) will survive termination.

13. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms in the App and/or on our website and update the "Last updated" date. For material changes, we will provide notice (e.g. in-app or by email) at least 30 days before the new terms take effect when reasonably possible. Your continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App.

14. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising from or related to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of India, unless otherwise required by mandatory law in your country of residence.

15. General

  • Entire agreement. These Terms (together with the Privacy Policy and any in-app rules we publish) constitute the entire agreement between you and SpeakVerse regarding the App.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
